In the County Court of the County of Linn, State of Oregon-

Your petitioner would represent that he has been duly appointed by this
court administrator of the estate of Abraham Osburn Sr., dec'd and that
immediately after his appointment as such administrator, he caused to be
published a notice thereof in the Albany Register a newspaper published in
said county once a week for four successive weeks as will appear from a
copy of said notice with the necessary proof of publication, hereto annexed
marked "A" - Petitioner further states that all the personal property of
said estate was set apart by this court for the use of the widow of the
deceased, that the claims that are outstanding against said estate are as
follows: an account due Wm. M. Morrow & son Geo for $33.21 - a note
secured by a mortgage on the real estate of said deceased due John
Ostrander for $228.44 bearing twelve per cent from January 12, 1869 - and
an account due your petitioner for $4.00 and that the charges and expenses
of administration that have accrued remain unpaid & that the foregoing
claims with the accrueing expenses are all the claims against said estate
so far as petitioner has been able to ascertain.  That the said deceased
died seized and possessed of the following described real estate to wit:
Lots No. 25 and 26 in the city of Scio, County of Linn, Sate of Oregon on
which is a dwelling house.  That said real estate is of the probable value
of $475.00 which is all the real estate owned by decedent as our petitioner
is informed and believes.  That there is a mortgage upon said real estate
in favor of John Ostrander for the sum $228.55 with interest at 12 per cent
from January 12, 1869 which became due September 1, 1869.

Your petitioner further stated that the names, ages and residence of the
heirs of said decedent so far as known are as follow: that is to say:
Elizabeth Osburn widow of deceased, age (blank), residence Lane County,
Abraham Osburn Jr. aged 29 residence Linn County, Oregon, Elizabeth McGee
aged 39 years and Mary Jane McCann aged 37 years, both of whom supposed to
reside in Henderson County, State of Illinois.

Wherefore your petitioner prays that an order be granted him authorizing
him to sell said real estate according to the statute in such cases made
and provided for the purpose of paying the claims against said estate and
the charges and expenses of administration and will ever pray to
